Returns and refunds

The goods must be returned to MABA Srl within the terms set out in point 14 together with the authorization form received.
Subject to any restoration costs for damages ascertained to the original packaging, MABA Srl will refund the User the entire amount within 14 days from the return of the goods through a chargeback procedure on the Credit Card or by Bank Transfer.
In the latter case, it will be the User’s responsibility to promptly provide the bank details to receive the refund (customer’s IBAN code).

Forfeiture of the right of withdrawal
The User forfeits the right of withdrawal and the consequent right to a refund if MABA Srl verifies the existence of even just one of the following conditions:
– Partial use of the goods and any consumable materials;
– Absence of the external packaging and/or the original internal packaging;
– Absence of product components (accessories);
– Damage to the product for reasons other than its transport.
In the aforementioned cases, MABA Srl will return the goods to the User, charging the shipping costs.

Applicable law

The purchase contract concluded on the Site is governed by Italian law.

It is without prejudice to the application to consumer Users who do not have their habitual residence in Italy of the more favorable and mandatory provisions provided by the law of the country in which they have their habitual residence, in particular in relation to the term for exercising the right of withdrawal, the term for returning the Products, in the event of exercising this right, the methods and formalities of the communication of the same and the legal guarantee of conformity.
It should be noted that in the case of a consumer user, for any dispute relating to the application, execution, and interpretation of these General Terms and Conditions of Sale, the court of the place where the user resides or has elected domicile has jurisdiction. In the case of a non-consumer user, for any dispute relating to the application, execution, and interpretation of these General Terms and Conditions of Sale, the court of Siena has exclusive jurisdiction.
The user residing in a member state of the European Union other than Italy can also access, for any dispute relating to the application, execution, and interpretation of these General Terms and Conditions of Sale, the European procedure established for small claims, by Regulation (EC) no. 861/2007 of the Council, of 11 July 2007, provided that the value of the dispute does not exceed, excluding interests, rights, and expenses, Euro 2,000.00. In accordance with the provisions of art. 14 of Regulation EU 524/2013/EU, the consumer User is informed that, as an alternative to judicial dispute, both the consumer and Alias may resort to online dispute resolution by submitting a complaint through the platform established by the European Commission. This tool can be used by the European consumer to resolve non-judicially any dispute relating to and/or arising from contracts of sale of goods and services stipulated online. Shipping

Shipping and Costs The cost of shipping is FREE throughout ITALY.

Delivery Times The delivery times of the goods vary depending on the availability in stock of the purchased product (for example, if the product is available from the manufacturer) and the delivery methods provided for it. In any case, the delivery date is purely indicative and is in no way binding for MABA Srl. MABA Srl uses affiliated couriers/carriers that offer the best quality/price ratio for the destination concerned: this allows us to offer our Customers advantageous prices and quality in the service. Under no circumstances will it be possible to carry out deliveries by appointment and/or at pre-established times and/or days. In case of non-delivery of the goods due to an incorrect address provided by the User or due to completed storage in the warehouses of the courier/carrier and/or in any case for any cause attributable to the User’s behavior, a new shipment will be possible ONLY after advance payment of the same according to the methods indicated by MABA Srl.

Goods Delivery At the time of delivery of the goods, the User is required to check:

that the number of packages delivered corresponds to what is indicated in the transport document;
that the packaging is intact and not altered even in the sealing tapes. In case of tampering and/or breakages, the User must immediately contest the shipment and/or delivery using the document received from the courier or another operator and affixing the writing “RESERVE TO CHECK GOODS FOR …” (indicate the reason).
The User must subsequently report any damages within 3 days from the receipt of the goods according to the methods provided by the operator who carried out the shipment.
